Despite providing crucial protections, the law has\u202fbeen under attack\u202fin recent years.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Normally, when birds die through activities like&nbsp;energy extraction, the MBTA helps hold companies responsible, and is a strong incentive to avoid such impacts in the first place.&nbsp;But a rule passed by the Trump Administration altered the MBTA so that&nbsp;incidental, as opposed to deliberate, bird deaths resulting from these activities&#8211;for example, birds killed in oil spills&#8211;will no longer result in prosecution.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"750\" height=\"500\" src=\"https:\/\/blogs.massaudubon.org\/yourgreatoutdoors\/wp-content\/uploads\/sites\/20\/2021\/02\/2556Nicole_Mordecai34674.jpg\" alt=\"\" class=\"wp-image-15255\" srcset=\"https:\/\/blogs.massaudubon.org\/yourgreatoutdoors\/wp-content\/uploads\/sites\/20\/2021\/02\/2556Nicole_Mordecai34674.jpg 750w, https:\/\/blogs.massaudubon.org\/yourgreatoutdoors\/wp-content\/uploads\/sites\/20\/2021\/02\/2556Nicole_Mordecai34674-300x200.jpg 300w, https:\/\/blogs.massaudubon.org\/yourgreatoutdoors\/wp-content\/uploads\/sites\/20\/2021\/02\/2556Nicole_Mordecai34674-624x416.jpg 624w\" sizes=\"auto, (max-width: 750px) 100vw, 750px\" \/><figcaption>Osprey \u00a9 Nicole Mordecai<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Now we have a chance to&nbsp;take action. <\/h3>\n\n\n\n<p>The US Fish and Wildlife Service\u00a0has\u00a0delayed\u00a0the\u00a0Trump Administration\u2019s\u00a0rollback, and\u00a0is taking input from the public as they consider their next steps.\u00a0You can\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.regulations.gov\/commenton\/FWS-HQ-MB-2018-0090-14244\" target=\"_blank\">submit\u00a0comments by clicking this link<\/a>\u00a0and tell USFWS\u00a0we need\u00a0to reinstate full\u00a0MBTA\u00a0protections!\u00a0<\/p>\n\n\n\n<p>Here\u2019s what you can&nbsp;copy and paste into the comment portal&nbsp;(or&nbsp;personalize your comments with a message of your own!):&nbsp;<\/p>\n\n\n\n<p><em>I urge&nbsp;the US Fish and Wildlife Service&nbsp;to reverse damaging rollbacks to the Migratory Bird Treaty Act, and to restore full protections&nbsp;under the&nbsp;law.&nbsp;Many of our bird&nbsp;species&nbsp;are already&nbsp;in trouble&nbsp;due to factors like habitat loss and climate change, with reports documenting a decline of 3 billion birds in North America since 1970.&nbsp;We can\u2019t&nbsp;stop holding companies responsible for bird deaths at a time when 76% of all bird species in the US are declining.&nbsp;<\/em><\/p>\n\n\n\n<p><em>The MBTA is the primary legislation protecting native birds in the United States, and&nbsp;we need it today more than ever.
